Mobile Messaging Terms

Motenza Capital is operated by IMG Business Consulting LLC, a Florida limited liability company established in 2020.

This SMS Communications Policy (“SMS Policy”) describes how Motenza Capital uses SMS and text messaging in connection with commercial funding inquiries, applications, verification, documentation, customer support, and related business services.

This SMS Policy supplements our Privacy Policy, Terms of Use, and Electronic Communications Consent.

Motenza Capital provides commercial and business-purpose services only. Motenza Capital is not a bank.

1. Current SMS Program

Motenza Capital’s current SMS program is intended primarily for transactional, informational, application-related, verification, and customer-support communications.

Our current SMS program is not intended for unsolicited promotional or mass-marketing text campaigns.

Messages may relate to:

confirmation that we received a business funding inquiry or application;
application status updates;
requests for additional business information;
document requests;
secure document-upload instructions;
identity or business-verification steps;
verification status updates;
appointment confirmations or reminders;
requests for clarification regarding an application;
communications regarding potential funding options requested by the applicant;
customer-support communications;
security or fraud-prevention communications where appropriate;
follow-up concerning an active business funding request; and
other service-related communications reasonably connected to a service requested from Motenza Capital.

The content and frequency of messages depend on the nature and status of the applicant’s request.

2. Motenza Capital SMS Number

Motenza Capital may send and receive authorized SMS communications through:

Additional Motenza Capital telephone numbers may be used in the future where appropriately registered, configured, and authorized.

3. How SMS Consent Is Obtained

Motenza Capital sends SMS messages only where an appropriate basis for communication exists and applicable consent requirements have been satisfied.

Our primary online opt-in method may include the Motenza Capital Business Funding Application at:

Where an SMS consent checkbox is presented through an online application or form:

the individual is provided with applicable SMS disclosure language;
the individual may affirmatively choose whether to receive SMS communications;
SMS consent is separate from merely providing a telephone number;
SMS consent is intended to be voluntary;
SMS consent is not a condition of submitting a funding application or receiving financing services; and
applicable Privacy Policy and Terms links are made available.

An individual may also initiate a conversation by sending an SMS directly to Motenza Capital.

Responding to a message initiated by an individual does not automatically enroll that individual in unrelated promotional messaging.

4. Consent Is Not a Condition of Service

Consent to receive SMS communications is not a condition of obtaining financing, submitting an application, purchasing a product, or receiving a service from Motenza Capital.

An applicant may decline SMS communications and may use other available communication methods where appropriate.

5. Providing a Telephone Number Is Not Blanket Consent

Providing a mobile telephone number to Motenza Capital does not, by itself, constitute consent to receive every category of SMS communication.

Any consent obtained applies only to the messaging purposes disclosed when the consent is provided and as otherwise permitted by applicable law.

Motenza Capital does not interpret an application submission as unlimited permission to send unrelated SMS communications.

6. No Purchased, Rented, or Shared SMS Consent Lists

Motenza Capital does not purchase, rent, or use third-party lists of SMS consent for the purpose of sending messages under this SMS program.

SMS consent obtained by another business, lender, broker, funding company, affiliate, lead generator, or third party is not treated as Motenza Capital consent merely because contact information is available to us.

7. SMS Consent Is Not Transferable to Funding Partners

Mobile telephone numbers, SMS opt-in information, and SMS consent are not sold, rented, transferred, or shared with third parties or affiliates for their own independent marketing or promotional purposes.

Submitting a business funding application to Motenza Capital may authorize appropriate use or disclosure of application information for funding evaluation as described in our Privacy Policy and other applicable authorizations.

However, sharing application information with a lender, funding provider, financial institution, broker, capital provider, service provider, or other transaction participant does not transfer Motenza Capital SMS consent to that party for its own marketing messages.

Each independent third party is responsible for obtaining any consent that it separately requires for its own communications.

8. Service Providers

Motenza Capital may use communications, CRM, technology, hosting, workflow, verification, security, and other service providers to operate our SMS program and related business systems.

Such providers may process telephone numbers, message content, delivery information, consent records, opt-out records, and related operational information as reasonably necessary to provide authorized services to Motenza Capital.

This operational processing does not constitute permission for those providers to use Motenza Capital SMS consent for their own independent marketing purposes.

9. Message Frequency

Message frequency varies.

There is no fixed number of messages associated with every applicant.

Frequency may depend on:

the stage of an application;
whether additional information is needed;
whether documents or verification are outstanding;
appointment activity;
customer-support requests;
responses from the applicant;
transaction status; and
other circumstances related to the requested service.

Motenza Capital seeks to limit messaging to communications reasonably relevant to the recipient’s interaction with us.

10. Message and Data Rates

Message and data rates may apply.

Any charges imposed by a wireless carrier, mobile provider, or service plan are the responsibility of the recipient.

Motenza Capital does not control carrier messaging or data charges.

11. How to Opt Out

Recipients may revoke SMS consent at any time.

The easiest method is to reply:

to an SMS message from Motenza Capital.

We may also recognize other clear opt-out requests as supported by our messaging systems and applicable requirements.

We will take reasonable steps to process valid opt-out requests.

12. What Happens After an Opt-Out

After an SMS opt-out request is processed, the recipient may receive one final confirmation message confirming that the opt-out has been completed.

After that confirmation, Motenza Capital will not continue sending SMS messages under the applicable SMS program unless:

the recipient subsequently provides new consent or otherwise re-enrolls;
the recipient initiates a new SMS conversation where a response is appropriate; or
communication is otherwise permitted or required by applicable law.

An SMS opt-out does not necessarily withdraw consent for separately authorized email, telephone, postal mail, or other communications.

13. Re-Enrolling in SMS

A recipient who previously opted out may be able to re-enable SMS communications by:

providing new SMS consent through an approved Motenza Capital opt-in method;
initiating a new SMS request where appropriate; or
using a supported re-subscription keyword such as START, YES, or UNSTOP, where supported by our messaging platform.

Re-enrollment may require confirmation or additional action.

15. Sender Identification

Motenza Capital intends for initial outbound SMS communications to clearly identify Motenza Capital as the sender.

Recipients should not rely on a text message claiming to be Motenza Capital if the sender or content appears suspicious.

16. Promotional and Marketing SMS

Motenza Capital’s current SMS program is focused on non-marketing, transactional, informational, application-related, verification, and customer-support communications.

Motenza Capital does not use the current SMS program as authorization for unsolicited promotional SMS campaigns.

If Motenza Capital introduces promotional or marketing SMS programs in the future, any additional consent, disclosures, opt-in mechanisms, messaging registrations, or other requirements applicable to those communications will be implemented before such messaging is used.

Consent to service-related SMS messages should not be interpreted as consent to unrelated future promotional SMS communications.

17. Links in SMS Messages

Certain legitimate Motenza Capital messages may contain links necessary to complete requested actions, such as:

secure application steps;
document submission;
identity or business verification;
appointment scheduling;
application-related webpages; or
other approved service functions.

Links may direct users to Motenza Capital webpages or authorized service-provider platforms used to perform requested services.

Recipients should not provide confidential information through a link that appears suspicious or inconsistent with the service they requested.

When uncertain, contact Motenza Capital directly before submitting sensitive information.

18. Sensitive Information

Motenza Capital may use SMS to notify an applicant that additional sensitive information or documentation is needed.

Whenever practicable, sensitive financial, identity, or business documentation should be submitted through an approved secure workflow or secure service rather than transmitted directly through ordinary SMS.

Recipients should not send passwords, authentication credentials, complete Social Security numbers, or highly sensitive financial documents through ordinary SMS unless specifically directed to an appropriate secure process.

19. Identity, Verification, and Fraud Prevention

SMS communications may be used in connection with legitimate identity, business, document, security, or fraud-prevention processes.

Motenza Capital or an authorized verification provider may request that an applicant complete an action through an approved verification workflow.

Motenza Capital will not use SMS consent as authority for unrelated third-party marketing.

20. Telephone Number Ownership and Accuracy

By providing a mobile telephone number and opting in to SMS communications, you represent that you are authorized to use or provide that telephone number for communications with Motenza Capital.

You should not provide another individual’s telephone number without appropriate authority.

If your telephone number changes, is disconnected, is reassigned, or is no longer under your control, you should notify Motenza Capital or update the information provided to us where appropriate.

Motenza Capital may discontinue SMS communications where we reasonably believe a telephone number is invalid, reassigned, unavailable, or no longer associated with the intended recipient.

21. Delivery Is Not Guaranteed

SMS transmission and delivery depend on telecommunications providers, mobile carriers, networks, devices, service availability, technical systems, spam filtering, and other factors outside Motenza Capital’s complete control.

Accordingly, Motenza Capital cannot guarantee that every SMS message will be delivered, delivered immediately, or available without interruption.

An SMS delivery failure does not necessarily indicate that an application, transaction, or service has been discontinued.

22. Carrier and Device Compatibility

SMS services may not be available on every carrier, device, plan, geographic location, or telephone number.

Certain numbers may not support SMS.

Wireless carriers and messaging providers may block, delay, filter, or reject messages based on their own systems, policies, network conditions, or applicable requirements.

23. Consent and Messaging Records

Motenza Capital may maintain records reasonably related to SMS communications, including:

telephone numbers;
opt-in records;
consent information;
date and source of consent where available;
message history;
delivery information;
HELP requests;
STOP or other opt-out requests;
re-subscription information; and
related customer-support or compliance records.

Such information may be maintained for legitimate operational, security, compliance, recordkeeping, dispute-resolution, or legal purposes as described in our Privacy Policy.

24. Privacy

Information associated with SMS communications is handled in accordance with the Motenza Capital Privacy Policy.

Our Privacy Policy explains in greater detail how Motenza Capital may collect, use, disclose, process, retain, and protect information.

26. Electronic Communications

Additional provisions regarding electronic communications and electronic records may be contained in our Electronic Communications Consent.

SMS consent does not replace any separate authorization or disclosure that may be required for:

credit information;
identity verification;
financial account information;
electronic signatures;
electronic records;
capital-provider requirements; or
other transaction-specific activities.

27. Business-Purpose Services

Motenza Capital provides commercial and business-purpose services.

Our SMS program is intended for communications associated with legitimate business inquiries and business-purpose services.

Motenza Capital does not use this website or SMS program to offer consumer-purpose personal loans or residential mortgage financing.

28. Minors

Motenza Capital’s business funding services and related SMS communications are not directed to individuals under 18 years of age.

We do not knowingly seek SMS consent from minors for commercial funding services.

29. Abuse, Fraud, and Unauthorized Use

SMS services may not be used to:

impersonate Motenza Capital or another party;
submit fraudulent information;
attempt unauthorized access to systems;
distribute malicious content;
interfere with messaging systems;
conduct phishing;
harass personnel or other users; or
engage in unlawful activity.

Motenza Capital may restrict or discontinue communications where misuse, fraud, security concerns, or unlawful activity are reasonably suspected.

30. Changes to This SMS Policy

Motenza Capital may update this SMS Policy as:

messaging practices change;
technology changes;
communications providers change;
services develop;
applicable requirements change; or
our business operations evolve.

The current version will be posted on the official Motenza Capital website with an updated revision date.

Where a change requires new or additional consent under applicable requirements, Motenza Capital will obtain such consent as required rather than relying solely on publication of an updated policy.
