Compliance

Responsible Business Funding. Transparent Practices.

At Motenza Capital, responsible business practices are an important part of how we operate. We are committed to maintaining transparent communications, responsible marketing practices, appropriate handling of applicant information, and professional relationships with our funding partners.

Motenza Capital operates as a commercial capital platform. We are not a bank or depository institution. Depending on the transaction, Motenza Capital may act as an arranger or referral platform, facilitate access to private or affiliated capital resources, or connect applicants with independent third-party funding providers. The entity identified in the final financing agreement is the actual provider of capital and is responsible for the applicable underwriting, disclosures, documentation, servicing, and transaction terms.

Responsible Marketing

We strive to present commercial financing opportunities clearly and responsibly.

Motenza Capital does not advertise guaranteed approvals, guaranteed funding amounts, guaranteed rates, or guaranteed financing terms. Any financing examples displayed on our website or marketing materials are for informational purposes unless specifically identified as an actual offer from a funding provider.

Motenza Capital may conduct an internal preliminary review. Final approval, pricing, financing amounts, repayment structures, and other transaction terms are determined by the applicable capital provider identified for the transaction.

Business-Purpose Financing

Motenza Capital focuses on financing solutions intended for legitimate business and commercial purposes.

We do not offer consumer-purpose loans or residential mortgage products through this website.

Applicant Information & Privacy

We take the handling of applicant and business information seriously.

Information submitted to Motenza Capital may be used to evaluate potential commercial financing opportunities and, with appropriate authorization, may be shared with selected capital sources, lenders, funding providers, processors, and service providers involved in evaluating or processing a funding request.

Our practices regarding personal and business information are further described in our Privacy Policy.

Responsible Partner Relationships

Motenza Capital seeks to work with established lenders, funding companies, financial institutions, and commercial financing providers that maintain professional underwriting and servicing practices.

Our goal is to provide funding partners with organized, accurate, and appropriately qualified business opportunities while respecting each partner’s underwriting criteria and submission requirements.

Accurate Submissions

Applicants are expected to provide accurate, complete, and truthful information.

Motenza Capital does not knowingly submit fraudulent documents, altered financial information, false identities, or materially misleading application information to funding partners.

We reserve the right to discontinue processing an application if information appears fraudulent, materially inaccurate, incomplete, or inconsistent.

No Upfront Application Fee

Unless specifically disclosed otherwise and permitted by applicable law, Motenza Capital does not charge an upfront application or broker fee simply for submitting a business funding request.

Motenza Capital may receive compensation in connection with successfully completed commercial financing transactions, including compensation from funding providers, capital relationships, or other transaction participants, as applicable and permitted by law.

Capital Review & Underwriting

Motenza Capital may conduct a preliminary internal review of a business opportunity. The provider of capital identified for the transaction is responsible for the applicable final underwriting and approval decision.

The applicable capital source or funding provider may review business revenue, cash flow, time in business, credit information, existing obligations, industry, ownership information, bank statements, financial records, and other relevant factors.

Applicants should carefully review all financing agreements and disclosures before accepting an offer.

Electronic Communications

Communications regarding applications, documentation, financing opportunities, and related services may occur electronically.

Additional information regarding electronic communications, telephone calls, text messages, and email communications is available in our Electronic Communications Consent.

Compliance With Applicable Requirements

Motenza Capital seeks to conduct its activities in accordance with applicable federal and state requirements relevant to its business model and the commercial financing structures considered through private or affiliated capital resources and independent funding providers.

Product availability and regulatory requirements may vary by jurisdiction. Certain financing products or partner programs may therefore not be available in every state.

Continuous Improvement

As our funding network and services continue to grow, Motenza Capital may periodically review and update its policies, procedures, marketing practices, technology, and partner standards to support responsible business operations.
